Criminal Defamation: Victor Ivan Vs Sri Lanka documents the long legal battle Victor Ivan fought, as a newspaper editor, against Sri Lanka’s criminal defamation law and the oppressive way it was used to harass journalists. A 1980 amendment to the Criminal Procedure Code let the Attorney General indict directly in the High Court without a preliminary magistrate’s inquiry. Ivan was the first person against whom that power was used. With his lawyer Suranjith Hewamanna, he chose not just to defend each case but to challenge the Attorney General’s discretion and the law itself. That strategy led to a fundamental rights petition in the Supreme Court naming the Attorney General as respondent.

When the Supreme Court dismissed the petition, Ivan took his complaint to the UN Human Rights Committee in Geneva (Communication No. 909/2000). The Committee decided in his favour on 27 July 2004. The book reproduces the whole process. That includes the Supreme Court petition and judgment, the complaint drafted by retired Supreme Court judge K.M.M.B. Kulatunga, the advice of Interights, and the written submissions of both sides. It also has the Committee’s decision, the government’s response and Justice Mark Fernando’s analysis. The criminal defamation law itself was abolished in June 2002. Ivan intended the collection as a practical guide for lawyers, scholars and citizens who want to take a complaint to the Human Rights Committee.
