Former Chief Justice Sarath N. Silva used interviews in Mawbima and Ceylon Today to recast himself and to claim that Ivan’s campaign against him grew out of a grudge from the 1971 insurrection trial. Ivan answers point by point: Silva was the most junior of five prosecutors, and Ivan’s lawyer in later cases was the lead prosecutor; the fight began when Silva, as Attorney General, shielded Magistrate Lenin Ratnayake. He recounts his challenge to the Attorney General’s criminal defamation indictments, rejected by Justice Mark Fernando but upheld by the UN Human Rights Committee, and the pending Supreme Court inquiry when Silva was made Chief Justice.

Prompted by a reader’s tip, Ivan sets out how former Elections Commissioner Dayananda Dissanayake obtained a prime plot in Nuwara Eliya on President Kumaratunga’s recommendation for Rs. 30,000 in 1995 and sold most of it five months later for over Rs. 5.2 million. Such favours, he argues, are the bribe the executive presidency pays for loyalty, continuing the plunder of estate land after 1977. Those who uphold the law are punished instead: Auditor General Wijesuriya forced out, Justices Wanasundera and Mark Fernando passed over, B.C. Perera driven from the Treasury, and Shirani Bandaranayake impeached.
ජනාධිපතිවරණය හා නීතියේ පාලනය
The Elections Commissioner has said he may have to withdraw from running the election because his orders are not obeyed — the police ignore him, and state media ignore the Competent Authority. However much authority the constitution grants him, nothing in the country lets him exercise it. This is not new: under Chandrika Kumaratunga an attempt to arrest the Elections Commissioner was stopped only by Attorney General Kamalasabesan’s intervention, and it was Chief Justice Sarath Nanda Silva who advised her to make it. The 1981 Jaffna district council poll was the first time a ruling party seized election administration outright, and Commissioner Jayasekera resigned over it. Since 1982 no election has been free and fair. Powers mean nothing while the ruler declines to obey the law.
කුමාර් පොන්නම්බලම් ඝාතනය
An investigative dossier on the January 2000 killing of Kumar Ponnambalam. It sets out a timeline linking the killing to the President’s televised attack on critics, and reports Mrs Ponnambalam’s accusation against the government and CID chief Bandula Wickremasinghe’s secret report naming Mahen Ratwatte as instigator. It reproduces the President’s two condolence letters (one wrongly dated), suspect Sugath Ranasinghe’s affidavit clearing Mahen Ratwatte, a lawyer’s letter for Ratwatte, and a transcript of Ranasinghe’s taped phone confession.
Plotters of legal conspiracy stuck in mud
How a state metes out justice is said to show how civilised it is. The contents of the impeachment motion against the Chief Justice, and the way power is being used to abort that impeachment, show how uncivilised the affairs of this country have become.
