Ivan traces Tony Fernando’s long search for redress after his employer refused to meet his private hospital bills following a workplace accident, through the Labour Commissioner, Human Rights Commission, Ombudsman, Speaker and Supreme Court, until the Chief Justice jailed him for a year for contempt and he was beaten in prison. He argues that Sarath N. Silva has placed close associates at the head of every institution of redress, including the human rights and bribery commissions, the Public Trustee and the prisons, forming an octopus-like net.

Ivan argues that the Constitutional Council, demanded by civil society to curb presidential appointments, was hollowed out from the start. He details how Jayampathy Wickramaratne’s draft of the 17th Amendment removed the seniority rule for the Judicial Service Commission to protect Sarath N. Silva, how the Speaker signed the unamended bill, and the injunction against the Speaker over the impeachment. He adds that the Council, made up only of lawyers, has set up just two commissions while the President blocks appointments such as Ranjith Dheeraratne’s.

The editorial accuses the President of abusing her powers under the distorted 17th Amendment. She has kept Priyani Wijesekera, the most senior and qualified candidate, as only acting Secretary-General of Parliament despite the 14-day limit on acting appointments, and passed over Justice Mark Fernando, whose ruling that presidential immunity ends with the term of office she resented, when naming an acting Chief Justice. It calls on all parties to correct the amendment.

Ivan explains that the 17th Amendment gives the Constitutional Council power over the independent commissions and top appointments, yet the President has still not named her nominee despite Article 41(5). He argues that she is protecting her hold over the Chief Justice, Attorney General, IGP and Bribery Commission, since a council would weaken her defence against impeachment and against the Padiyapelella rocket-launcher case linked to a plot to kill S.B. Dissanayake.
Dishonourable acts taint an ‘honourable’ judicial service
The questions raised about the Judicial Service by the conduct of Magistrate Lenin Ratnayake, District Judge Upali Abeyratne and Attorney General Sarath N. Silva — three men at three different levels of it — are serious indeed.
